TERMS AND CONDITIONS.

Grupo Posadas, S.A.B. de C.V. has established and operates the Fiesta Rewards Motiva Program, which is a point-based loyalty program; its characteristics, scope, policies, and restrictions are governed by these terms and conditions.

  1. General Conditions Fiesta Rewards Motiva.
    1. Membership in the Fiesta Rewards Motiva program is completely free.
    2. The decision to join and remain in the Fiesta Rewards Motiva program rests exclusively with the individuals who enroll in the program. Enrollment and/or continued membership in the Fiesta Rewards Motiva Program is not a requirement to receive or make reservations for services offered by hotels operated by the Group or services provided by other affiliated companies of the program.
    3. It is the obligation of members to know and comply with all the rules and policies of the Fiesta Rewards Motiva program. Each member will assume the responsibility of regularly updating and informing themselves about said regulations in order to understand their rights and responsibilities.
    4. Accumulated points have no monetary value of any kind and their sale, gifting, or transfer to any account other than that of the member who accumulated them is prohibited, as the point credit is non-transferable and non-combinable between members of the Fiesta Rewards Motiva program. Transgressors are responsible for any damages, legal costs, and operational costs that may be incurred.
    5. The Fiesta Rewards Motiva program reserves the right to modify or terminate partially or totally, as deemed necessary, the regulations, rules, privileges, benefits, travel rewards, or special offers of the Fiesta Rewards Motiva program, at its discretion and without prior notice. This means that the Fiesta Rewards Motiva program can introduce changes that affect, for example, member affiliations, rules for crediting points, point levels, and tables for obtaining rewards.
    6. In the event of the termination of the Fiesta Rewards Motiva program, all points accumulated by members will be voided by the Fiesta Rewards Motiva program, and the program will have no responsibility regarding the accumulated points and rewards not redeemed or used by its members.
    7. The Fiesta Rewards Motiva program may integrate new affiliated companies. In this case, members will be informed, as deemed appropriate, about the new alliance and the conditions imposed by said companies. On the other hand, hotels, car rental companies, or other companies affiliated with the program may terminate their participation without prior notice. Likewise, promotional calls may be made to the number registered in the member's account.
    8. The accumulation of points and the use of rewards with affiliated companies are subject to the permanence of such companies as participants within the Fiesta Rewards Motiva program. The program is not responsible for rewards redeemed and not used during said period of permanence.
    9. The Fiesta Rewards Motiva program reserves the right to cancel the membership of any member who, in the program's judgment, has committed fraud, abuse, or a violation of any of the point credits, benefits, use of rewards, or any other regulation of the Motiva program, as well as in the event that a hotel requests it from the program. Upon disqualification, a member loses all their membership rights, including all their accumulated points, privileges, and benefits, and is subject to administrative and/or legal actions by the Fiesta Rewards Motiva program, as the case may be. The immediate cancellation of the account and the member's future participation will also proceed.
    10. The Fiesta Rewards Motiva program will publish a summary of the member's account activity on its website, provided that accumulation, usage, or point expiration operations have been registered during the period covered by said summary. You must request a password by calling the Fiesta Rewards Line at 443 113 5841.
    11. The Fiesta Rewards Motiva program reserves the right to review the balances of points accumulated by members. The issuance of rewards may be suspended until any discrepancy or anomaly observed is satisfactorily resolved.
    12. The Fiesta Rewards Motiva program reserves the right to deduct points mistakenly credited to a member, also reserving the right to award supplementary points due to specific promotional campaigns, which are duly announced to members, or for compensation or goodwill. For the purpose of such point bonuses, the Fiesta Rewards Motiva program reserves the right to award them to a portion or segment of the program's members, according to the parameters of a specific promotion or as deemed appropriate, without this becoming an obligation to award them to all members.
    13. In order to receive the benefits of the Fiesta Rewards Motiva program at our Live Aqua, Grand Fiesta Americana, Curamoria Collection, Fiesta Americana, Fiesta Inn, Gamma, One and The Explorean hotels, the member must reserve lodging services by paying any rate. Group rates, plans contracted with Gran Plan, VTP or package tours (hotel + flight) whose cost is not specified separately do not apply.
    14. For the purpose of retroactively regularizing the account, the member must keep the invoices and/or vouchers or contracts that were issued in the name of the executive who made the reservation at the Live Aqua, Grand Fiesta Americana, Curamoria Collection, Fiesta Americana, Fiesta Inn, Gamma, One and The Explorean hotels.
    15. The accumulation of points can be requested for no more than 100,000 points in one month for past operations that meet the established requirements: with a maximum of 6 months after the check-out date, by presenting the requested documentation. The Program reserves the right to verify all documentation presented for late credits, provided the member had enrolled in the program before checking out from their stays.
    16. Points can only be accumulated for qualified stays after the enrollment date (before taxes and service charges). The crediting of Motiva Points will be reflected in the member's account a maximum of 5 calendar days after the guest's check-out.
    17. In case of death, only the first-degree descendants or the spouse of the member can make use of the points accumulated for any reward from the Motiva program's catalog. It will be necessary to prove the member's death by presenting the corresponding death certificate.
    18. Motiva points that are deducted due to expiration can be reactivated by paying a fee of $4.50 USD plus VAT for every 1,000 points. The validity for using these points will be 12 months from the reactivation date. The maximum limit of points that can be reactivated is 70,000 Motiva Points in one month.
    19. In the case of being a Grupo Posadas collaborator, enrollment and participation in the Motiva program is prohibited.
    20. A Motiva member can also be a member of the Fiesta Rewards Program at the same time. In these cases, point accumulation for the stay can only be done for one program and not for both.
    21. If a member is short on points to obtain a reward in the Motiva program, they can buy them by calling the Fiesta Rewards Motiva Line at 443 113 5842. These will have a cost of $11 USD plus VAT for every 1,000 points. Once the point purchase is processed, there will be no cancellations. The maximum amount the member can buy in a calendar month is 100,000 points. In the event that a single operation acquires 40,000 points or more, for security purposes, it will be necessary to provide a letter justifying said purchase. The validity of the points will be 1 year from the purchase date.
    22. A member can redeem their points to reserve a maximum of 9 rooms per day. If more than 10 rooms are needed, they should contact the Motiva Line.
    23. In the event that the member had made a reservation for lodging at a hotel in accordance with the provisions of the Motiva program and it was not honored, the Fiesta Rewards Motiva program will offer said member as a first option lodging at another hotel operated by Grupo Posadas, S.A.B. de C.V. or one of its subsidiaries, at the member's convenience, under the same category and quality contracted in the initial reservation or the replacement of the Motiva points that could not be used due to the aforementioned. There will be no responsibility on the part of the Motiva program for non-compliance with the reservation due to causes beyond the program's control, such as a fortuitous event or force majeure, which implies that the member is not granted the right to demand any type of compensation from the program.
    24. By subscribing to the program, the member is obligated to provide the Fiesta Rewards Motiva program with the information required in Annex "A" of the subscription and supplement form, regarding the beneficial owner in the event that the monthly Motiva point accumulation exceeds the Identification threshold established in the applicable legislation in accordance with article 17, section II of the LFPIORPI. In case of non-compliance or falsehood in the information provided, the Fiesta Rewards Motiva program will proceed to cancel the membership and the points accumulated by the member will be voided, without any responsibility for the Motiva program.
    25. The Fiesta Rewards Motiva Loyalty Program is given in a general way to all its members, in accordance with the assumptions described in these terms and conditions, as part of the benefits that they have for staying in the Hotels managed by Grupo Posadas, without this representing under any circumstance a specific benefit derived from the member's position. In the event that any member should not enjoy this Program by virtue of any Law or regulation so indicating, they are obligated to communicate it to Grupo Posadas at the moment such a disqualification arises for the purpose of canceling their membership and to pay for any damages that may arise from said lack of communication.
  2. Motiva Member
    1. All persons enrolled in the Fiesta Rewards Motiva program are members.
    2. 5 points will be accumulated for every dollar on the total invoiced before taxes at any Live Aqua, Grand Fiesta Americana, Curamoria Collection Fiesta Americana, Fiesta Inn, Gamma, One and The Explorean hotel.
    3. In order for the member to credit points, it is necessary to mention their membership number when booking at the Central Reservations at 800 504 5000 or on our hotel websites. In this case, the credits will be made directly. When making a reservation through globalizers (Amadeus, Galileo, Sabre or Worldspan), you must enter the Motiva membership number in the comments field (Special Information/Special Request/Supplementary Information) as follows: MOTIVA12345678 without spaces to ensure your reservations automatically credit points. Effective reservations are those where the stay was completed.
    4. Points do not expire as long as the member maintains activity in the last 12 months, meaning they have had credits during that period. If there is no activity, the points will expire automatically.
  3. Rewards
    1. The Fiesta Rewards Motiva program and its affiliated companies reserve the right to modify the conditions for obtaining all benefits, especially rewards, bonuses, and the number of points required, or to void any benefit offer without prior notice and with immediate effect.
    2. The obtaining of rewards is subject to availability.
    3. Upon accumulating sufficient points for the redemption of a reward, the member can make the respective request through the website www.fiestarewards.com or by calling the Fiesta Rewards Line at 443 113 5841.
    4. Upon processing the benefit request, the member agrees that the necessary points corresponding to the requested benefit will be taken and deducted from their account, according to the rewards table in force on the date of the request; the oldest points that qualify for obtaining said benefit will be deducted with priority. Some benefits may have additional restrictions. It is the member's responsibility to regularly update themselves on the conditions and/or restrictions of promotions and point usage.
    5. The Fiesta Rewards Motiva program reserves the right to deny a room reservation request that has been made without having previously indicated or notified that it was a reward request.
    6. In case of changes or cancellations of hotel reservations, the member must abide by the policies of each hotel, which may be modified according to the season. In the event that the member does not show up on the first night or their departure is early, the total points for the unused nights will be deducted.
    7. The Fiesta Rewards Motiva program or the hotels participating in the program reserve the right to charge any applicable taxes.
    8. During holidays and high-demand seasons, a certain number of reward rooms are allocated, so we suggest making your reservation as far in advance as possible. The Fiesta Rewards Motiva program reserves the right to change or modify its seasons without prior notice and without any liability.
    9. Reward claim: The member will receive their reward a maximum of 15 business days after the redemption date. In case of loss, they will have 1 month and 15 days to claim the un-delivered reward. After the 3-month period has concluded, Motiva will not be responsible for the un-delivered redeemed reward. The member will have 48 business hours to make any claim regarding the delivered reward. This is as long as the original packaging, label, and no signs of abuse are kept. In some cases, the member will be asked to validate the reward at the time of delivery, so they will not be able to make future claims.
    10. Certificate claim: the balance validity and terms of use must be confirmed directly with the alliance. The member must consider the request and shipping time. Validity changes are not allowed and there will be no replacement. In case activation is required, it can be requested in a period not exceeding six months from the delivery date.
    11. Motiva members cannot belong to the Apreciare program or vice versa.
    12. The delivery time for rewards will be up to 15 business days from the point redemption date.
    13. Product delivery is only made within the Mexican Republic from Monday to Friday from 9:00 a.m. to 6:00 p.m.
    14. The Motiva member must contact the Fiesta Rewards Line at 443 113 5841 to file a report in case of any of the following events:
      1. Fiesta Rewards Motiva offers the guarantee that the manufacturer provides in its service centers, with these being in charge of evaluating and determining if the item will be subject to repair or physical replacement.
      2. If there is a mistake in the item or certificate sent, the claim must be made within the first 48 business hours after receiving the product. This is as long as the original packaging and label are kept and it shows no signs of abuse.
      3. If the product is an exchange requested by the customer, the shipping costs incurred will be covered by the customer. In the event that merchandise is sent with freight collect, your order refund will not be valid.
    15. The Motiva Line advisor will generate a ticket number that will be provided to the member for follow-up on their clarification and will indicate the steps to follow. Once the ticket is generated, a response will be given to the member within the first 48 business hours.
    16. Fiesta Rewards Motiva will not proceed with returns that are not accompanied by the corresponding report number (RMA), which will be provided by our Service Center.
